Divorce – In Nebraska, as long as both parties agree that the marriage is irretrievably broken, a divorce is relatively easy to obtain. In the event that one of the spouses disputes the viability of the marriage, the courts will make a determination. In either event, attorney Robert Chapin has experience in representing clients in contested and uncontested divorces.

Child Custody/Visitation – When making a determination of child custody, the Nebraska courts consider the child’s relationship with each parent; the wishes of the child; and the health, social behavior, and welfare of the child. Naturally, any history or signs of abuse by either parent will also factor into the court’s decision. The courts may award joint custody or sole custody with visitation—depending on which is in the best interests of the minor child. It is unlikely that the courts will award sole custody without also awarding visitation to the non-custodial parent. The gender of the parents is not a factor that the courts will consider in deciding custody.

Child Support – Child support is awarded in accordance with the State’s child support guidelines. The income of the non-custodial parent is considered with the requirements of the child.

Alimony/Support – In some cases, the Nebraska courts will award spousal support to continue the financial security of one of the parties. Spousal support will be terminated upon the death or remarriage of the individual receiving the support.
